Landowners can be legally liable for what they allow to happen on their land. They have the legal right to control access to their land and they can decide who, what and where they allow access to their property.

As a Passport holder you are responsible to ensure your activities do no harm and cause no damage. The landowner is not responsible for monitoring your actions. There are several laws and regulations that outline the landowners’ rights and BCWF members’ restrictions. These laws and regulations have very strong legislation and associated penalties. You can be sued if you cause damage or allow damages to occur due to neglect, even if you were given permission to access private or leased land.

The matter could end up in Civil Court either by the land owner or their insurance carrier. More information about the BC Court system can be found here: Ministry of Attorney General
